Open Question: is the condo association responsible for foundation damage to my condo that is causing severe flooding?

the condo i live in floods itself about once a week due to a problem with the foundation of the condo, we think that the condo itself was built wrong. the condo is at the lowest spot of all of them nearby so water from underground often comes up through the foundation and fills my basement. i dont think i am responsible for this but the condo association says they are not legally responsible
